Terms & Conditions

These Terms & Conditions ("Terms") govern your use of services provided by Apex Payment Solutions Ltd ("Apex", "we", "us"). By applying for or using our card payment services, you agree to be bound by these Terms.

1. Services

Apex provides card payment terminals, merchant acquiring services (through FCA-regulated partners) and related software. The specific services you receive will be set out in your Order Form and Merchant Agreement.

2. Eligibility

Our services are available to UK-registered businesses, sole traders and partnerships. You confirm that all information provided to us is true, accurate and complete, and that you will keep it up to date.

3. Fees & Charges

You agree to pay the monthly terminal hire and transaction fees set out in your Order Form. Fees are debited monthly by Direct Debit. We will give you at least 30 days' written notice before changing any fees.

4. Term & Termination

Your initial term is set out in your Order Form (typically 12, 24 or 36 months). After the initial term your agreement continues on a rolling monthly basis until either party gives 30 days' notice. Early termination may incur charges as set out in your Order Form.

5. Hardware

Card terminals remain the property of Apex (unless purchased outright) and must be returned in working condition at the end of your agreement. We provide free next-day replacement for faulty units for the duration of your contract.

6. Liability

Our liability for any loss arising from our services is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for any indirect, consequential or business losses, except where prohibited by law.

7. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
